RENTAL AGREEMENT STANDARD TERMS AND CONDITIONS

Katerina’s rent a car hereby rents Vehicle (including any replacement vehicle) to Renter subject to all terms and conditions on the front page and this page and Renter in consideration thereof agrees to them as the essence of the Agreement.

1. DELIVERY AND RETURN
   

   The Vehicle is delivered to the Renter in good overall condition and without apparent defects and any complaints as to its condition must be made to Katerina’s rent a car immediately on delivery. The Renter agrees to return it with all documents and accessories and in the same condition to Katerina’s rent a car at the location and on the date designated in this agreement otherwise Renter shall be responsible to compensate Katerina’s rent a car in addition to the normal rental charge. Katerina’s rent a car reserves the right to repossess the vehicle at any time without demand at Renter’s expense if vehicle is used in violation of this agreement.

2. THEFT, DAMAGE, ETC.
   

   Renter has the obligation to compensate Katerina’s rent a car in the event of theft, loss or damage to Vehicle and to any person (including his co-passengers) as well as to pay all losses and damages suffered by Katerina’s rent a car. More specifically : (a) Renter is responsible for all the damages he has caused to Vehicle or to others, in case he has violated the terms of use of Vehicle or in case has been driving in an illegal manner or in violation of the Greek Driving Code. (b) Renter is responsible for partial or total theft or loss of Vehicle, unless Katerina’s rent a car releases Renter from the responsibility for total theft or loss of Vehicle. Such release is valid provided that Renter has already accepted at the beginning of rental the daily charge and the conditions of “Theft Protection” (T.P.) of Vehicle and “Collision Damage Waiver” (C.D.W.) by initialing the “Accepts” box on the front side of this agreement, provided that Renter has taken all the precautions to avoid total theft or loss of the Vehicle and has used it in compliance with the terms of this agreement. It is expressly agreed that theft or loss of parts, accessories and or equipment (partial theft) of Vehicle is not covered by the above-mentioned acceptance of “Theft Protection” and “Collision Damage Waiver (C.D.W.). (c) Renter is responsible for every damage or loss of Vehicle due to collision or fire, unless Renter has accepted the term “Collision Damage Waiver” (C.D.W.) by initialing in the “Accept” box on the front side of this agreement and by paying the respective daily charge. The above-mentioned acceptance of “Collision Damage Waiver” (C.D.W.) does not release Renter, if Vehicle was not used in compliance with the terms of this agreement and particularly in compliance with the terms of use (article 4). The said acceptance of “Collision Damage Waiver” due to collision or fire (C.D.W.) does not cover damages caused 1. To the lower part of Vehicle if it was driven on non-asphalted roads or at the sides of roads (ditches). 2. To the tyres and wheels of Vehicle. 3. During loading, unloading or transport of the Vehicle by ships or other means of transport without Katerina’s rent a car prior written consent.

3. CHARGES
   

   Renter shall pay Katerina’s rent a car on demand at termination of the rental unless agreed otherwise the sum of: A) All time and mileage charges computed at the rates shown, on the front page of this agreement. B)All basic delivery and collection charges, when applicable to the rental. C) Any state taxes and service fees on the rental. D) Katerina’s rent a car costs including attorney’s fees, delayed interest incurred in collecting payments due from Renter under this agreement. E) Fines, Penalties, Forfeitures, Court costs and other expenses, if assesses against Katerinass rent a car under compulsion of law with respect of use of Vehicle before its proper return to Katerina’s rent a car unless due to fault of Katerina’s rent a car but this shall not relieve Renter or authorised driver from there own unlawful conduct, F) Any amount for replacement of destroyed tyres, repairing mechanical damages and tear on the body of the vehicle. G) Granted discounts will be recalled, if settlement of accounts is not made within the set limits. H)Ail charges are subject to final audit.

    

4. CONDITIONS OF USE
   

   The Renter is expected to look after the vehicle carefully, to check its mechanical condition, oil, water, tyres etc. Any repair of the Vehicle by Renter himself or any other party designated by Renter is not Allowed without Lessor’s prior consent In particular, Vehicle must not be used: A) to carry persons or property for hire; 6) to propel or to tow any vehicle, trailer or other object C) in race, test or contest; D) while Renter or any other authorised driver of the Vehicle is under the influence of alcohol, hallucinatory drugs, barbiturates, or any other substance impairing his consciousness or ability to react; F) in contravention of any customs, traffic or other regulations; G) by any person other than the Renter unless such person has been previously designated and authorised by Katerina’s rent a car in the space provided on the front page of this agreement; H) to transfer or carry heavy luggage or objects, inflammable materials, staining or badly smelling goods, narcotics etc. I) outside Greece without advance authorisation of Katerina’s rent a car in writing.

5. EXTENSION OF RENTAL PERIOD
   

   If Renter wishes to prolong the rental period of the Vehicle, he has to contact Katerina’s rent a car within 48 hours before the initial expiration time of the rental to obtain permission for the additional rental period. Failing to do so will make Renter liable civilly and penally for illegal use and possession of the Vehicle. In case of extension Renter shall be bound by the terms and conditions agreed h Katerina’s rent a car or in respect of any replacement Vehicle rented in lieu of the Vehicle.

6. INDEMNITY
   

   Katerina’s rent a car is only responsible for loss or damage suffered by Renter or Third Parties in connection with the renting or the use of the rented car where such loss or damage was caused intentionally or through gross negligence on its part. In all other cases Katerina’s rent a car cannot accept any such Liability and Renter shall hold Katenna’s rent a car not responsible against any such claims.

7. ACCIDENTS
   

   In case of an accident or any other incident (fire, theft etc.). Renter or the additional driver is obliged to immediately do the following (a) Not acknowledge liability or guilt and claims of third parties in any way, direct or indirect (b) Note the names and the addresses of eye witnesses and also the name and the address of the driver and the data of the vehicle, with which vehicle may have collided. (0 Notify the Police to investigate the liability of the third party and provide care to any injured parties. (d) Contact Katerina’s rent a car immediately by phone or fax (e) Obtain a;1 relevant information from any third party. (f) Photograph the location of the accident and the vehicles participating in the accident, if possible. Renter must complete and sign an accident/theft report within twenty four (24) hours at the nearest Katerina’s rent a car branch and send any relevant documents or information to Katerina’s rent a car. in case of theft or loss of vehicle Renter must report the incident in writing at the nearest police department within twenty four (24) hours

8. INSURANCE

   A) Katerina’s rent a car provides Renter and any additional driver with insurance coverage by insurance compdnies of its choice for death or injuries of third parties, passengers or not, of Vehicle (the Vehicle driver is excluded) to t amount of EURO 1.000.000 and for material damages of third parties to the total maximum amount of Euros,. EUR 1.000.000 provided that they do not violate any term of this agreement. (b)Katerina’s rent a car provides insurance coverage against third parties only to those persons who use Vehicle with its permission, by an insurance policy, the terms of which are available for examination. (c) Renter, additional authorised drivers of Vehicle are not covered by Personal Accident Insurance” (RA I) unless Renter accepts “Personal Accident Insurance” at the beginning of rental by initialing in “Accept” box on the front side of this agreement, thus accepting the coverage provided by insurance policy for personal accidents paying the respective daily charge. (d) Luggage is not covered by irsurance and Renter is responsible for any loss or damage of property belonging to him or not Katerina’s rent a car hOds no responsibility for any such loss, damage etc. at the time of rental or after the return of Vehicle to Hire Car Corfu.

9. PERSONAL DATA
   

   It is strictly agreed that Katerina’s rent a car is authorised to use such data, when Renter at time of rental makes incorrect statements or violates the terms of this agreement and to pass on such data to the Country Authorities in case there is suspicion of committing a criminal or other offence

10. MISCELLANEOUS
    

    (a) Vehicle is always property of Katerina’s rent a car. This is an agreement of rental only. Renter is not a Katerina’s rent a car agent in any way and in any case. Renter acknowledges that he acquires no rights other than those stated in this agreement. (b) During the rental all additional drivers are jointly and seperately liable with the Renter. (c) Likewise, in case this agreement is signed by any representative of the Renter, he would be jointly and seperately responsible with the Renter. (d) This agreement supersedes any other prior written or verbal agreement between Katerina’s rent a car and the Renter. (e) Katerina’s rent a car can not waive any of its rights deriving from the law and this agreement. (0 Any alteration of the terms of this agreement is not valid if not agreed in writing. (g) Renter agrees and accepts that all above-mentioned terms are valid both in case of the initial agreement with Katerina’s rent a car and in any case of extension of the time of the rental and/or replacement of the Vehicle by another. (h) in case there is difference between the copies and the original of this agreement the original possessed by Katerina’s rent a car always supersedes, (I) The contracting parties acknowledge and accept that all terms of this agreement are substantial and fundamental for the purposes hereof.

11. JURISDICTION
    

    This agreement is governed by Greek Legislation and any and all disputes which may arise between Katerina’s Rent a car from this agreement will be subject to the exclusive jurisdiction of the Greek courts.
